John Schmidt is a family law attorney serving Shepherdsville and Bullitt County for more than 25 years. A family law lawyer can help with many family-related legal issues, such as:
· Legal separation
· Divorce
· Child custody & parenting time (visitation)
· Division of marital property
· Division of retirement accounts and pensions
· Child support
· Maintenance or spousal support
· Post-decree modifications
· Move-away or relocation child custody issues
· Pre-nuptial or Post-nuptial agreements
There are two primary ways to conduct a divorce here in the Commonwealth of Kentucky: uncontested or contested divorce. If you and your spouse are in complete agreement on every issue regarding the end of your marriage, you may choose to file for an uncontested divorce. This is usually the fastest and most affordable option for many couples. The Law Offices of John Schmidt & Associates have decades of experience drafting, reviewing, or editing necessary paperwork while genuinely and thoroughly capturing our clients’ intentions without unnecessary costs.
In many cases, it just isn’t possible to agree on every issue associated with the end of a marriage. A divorce in Kentucky is designed to protect the interests of each party while helping to resolve each and every issue associated with your divorce. My name is John Schmidt, and after more than two decades of experience in these cases and experience of my own, I work to help support my clients, protect their interests, find common ground, and find efficient and effective solutions to areas of disagreement.
Once the divorce has been finalized, any changes to child custody, support, or maintenance must be managed through a post-degree modification. If the parties are in complete agreement regarding the changes, it is wise to work with our law firm to put those changes in writing in the proper format and submit them to the Court for review and approval. It is not enough to simply agree to and make a change, especially when it comes to child support or maintenance (spousal support).
If there is some disagreement, the parties can ask the Court to decide and implement change orders. The Court almost always requires a significant change in the Status Quo (the circumstances that existed when orders were issued) before agreeing to hear a post-decree modification case. As a family law attorney serving Shepherdsville and the surrounding communities and counties, I can help you determine the best course to legally protect your interests and accomplish your objectives.
Child Custody, Visitation and Support Attorneys
In Bullitt County, as well as Hardin, Spencer, Shelby, Oldham, and Jefferson counties, Kentucky family law requires our judges to begin with the rebuttable presumption that it is in each child’s best interests to spend relatively equal quality time with each of their parents during and after a divorce. There are reasons to deviate from this schedule, especially when those issues involve the health, safety, or other best interests of the child(ren). Our law offices work with each client to determine the best possible outcome for you and your family and to make sure that all issues associated with child custody, parenting time, child support, decisions regarding education and medical treatment, religious practices, and the children’s best interests are protected.
Once your divorce is finalized, a substantial change or two will inevitably occur. This can involve the relocation or a move of one of the parents that share custody, changes in job status or income, as well as changes in behaviors, including abuse, domestic violence, and addiction or DUI. Post-decree changes and modifications require extensive knowledge and experience. As a family law attorney serving Shepherdsville and surrounding communities, we’ve witnessed and worked on almost every type of child custody, visitation, and support matter you might encounter, and we are prepared to help protect your goals and interests as well as the best interests of your child(ren).
