During the pandemic of 2020, the State of Kentucky made substantial changes to laws relating to Driving under the Influence of alcohol, drugs, or medication (DUI), as well as the impact of an ignition interlock on a DUI here in our State.
A Kentucky DUI ignition interlock device prevents someone with alcohol in their system (0.02%) from starting a car, truck, or other motor vehicle. All qualifying interlock devices must be certified by our Kentucky Transportation Cabinet (KYTC). This relatively new Kentucky Ignition Interlock Program (KIIP) changed how things work. Instead of applying to the Court, one applies directly to the Kentucky Transportation Cabinet. The KYTC has the authority to monitor this program for anyone who participates as part of a DUI.
The best news is a Kentucky DUI ignition interlock device can reduce the consequences of a DUI conviction. Those who apply to and are approved for an interlock through the KIIP become eligible to seek lesser penalties related to the time their driving privileges will be suspended in Kentucky. KIIP requires program participants to go through 90 to 120 days of driving without alcohol, based upon the interlock device and other factors such as not being charged with another DUI. If the participant completes this period successfully, we can seek a reduction of the suspension of their driving privileges.
The Kentucky DUI ignition interlock device is relatively simple. You provide a breath sample before starting your vehicle by blowing into a tube. If your blood alcohol level is below 0.02%, the device will allow the vehicle to start. If it exceeds this limit, the ignition interlock will prevent you from being able to start the vehicle.
