Reasons to Modify Child Custody and Parenting Time

What are some of the reasons to modify child custody and parenting time in Shepherdsville, Bullitt County or anywhere in the greater Louisville, Kentucky area?  The first requirement for the Court to entertain a change is usually a significant change in the “status quo.” The status quo refers to every aspect of the relationship between the parents and the circumstances surrounding each child.

For example, has one of the parents experienced a change in work hours, an increase or decrease of more than 10% in their income, or a DUI (bringing their judgment and potential addictions into question).  Is there a concern about domestic violence?  The safety and well-being of every child in Kentucky is a primary concern of our Family Court.

Has a professional change resulted in a different work schedule or demands that might change the ability to serve the best interests of the child(ren) associated with a parenting agreement or order?  Has a custodial parent’s move resulted in an increased ability to support the day-to-day routines of the child(ren)?

Has there been a change in the role of either parent from the perspective of the life of a child?  This might apply to assisting with the child’s transportation to or from school or after-school supervision, extra-curricular activities, religious practices or medical care.  Has the child reached an age of maturity or expressed a desire to spend more time with one of their parents?  Does the child wish to primarily live with the other parent?

The Court almost always wants to ensure each child has an open chain of communication with each parent.  Any attempt to interfere with the relationship between a child and the other parent can serve as one of the most important reasons to modify child custody and parenting time orders.  These actions may include interference in the other parent’s visitation schedule with a child, such as scheduling appointments or other events during the other parent’s scheduled visitation time(s).
