How do I appeal a substantiation of abuse by Child Protective Services (a/k/a CPS)?

To request an administrative hearing for appeal of finding of child abuse or neglect by the Cabinet for Health and Family Services (a/k/a Cabinet), please complete the form:

A request for an administrative hearing shall be mailed within 30 days from receipt of the substantiated investigation notification letter.

The request for an appeal must be in writing and should include adescription of the nature of the investigation, the reason you dispute the Cabinet’s substantiated findings, the name of each known Cabinet staff person involved with the investigation, and a copy of the notice of substantiated finding of child abuse or neglect if available.

You may request assistance of the Cabinet if you are unable to complete the appeal form without assistance. You should submit your written appeal no later than thirty (30) calendar days from the date of the notice of substantiated finding of child abuse or neglect is mailed or delivery of the notice if not mailed.

If you file an appeal, then you are the appellant. You can expect a final administrative action to be taken by the Commissioner or designee within ninety (90) days of the request date for an administrative hearing unless waived by you, the appellant.
